The problem

The classification lives in one person's head, and one wrong shipment costs you the program.

The export compliance manager at an aerospace tier puts it like this: “I have three people who know how to classify USML and ECCN. When one leaves, half the knowledge walks out with them”. And the rest of the flow is no better:

  1. Classification by expert eye — USML, ECCN 9A610, EAR99: every new part demands technical and regulatory analysis. There is no automatic catalog.
  2. Manual screening — the customer and the freight forwarder have to be checked against SDN, the Entity List, Denied Persons, Military End-User and the EU/UK lists. By hand, shipment by shipment, exactly when sales is pushing to get it out today.
  3. License tracked in Excel — DSP-5, DSP-83, TAA, MLA, BIS license: each one has specific coverage (which part, what quantity, which destination, which date). Knowing whether a license covers a shipment means cross-referencing three documents.
  4. A scattered per-shipment dossier — the day the DDTC or BIS auditor arrives, reconstructing what was done on every past shipment is weeks of work.

The classic system (compliance officer + Excel + a trained eye) works 99% of the time. That 1% is a consent agreement with the US government, a multi-million penalty, debarment from programs and a headline in Defense News. The asymmetry is brutal: the cost of preventing is ridiculous compared with the cost of failing.

What is the difference between ITAR and EAR?

ITAR (International Traffic in Arms Regulations, 22 CFR 120-130) is administered by the US State Department — the Directorate of Defense Trade Controls (DDTC) — and covers everything on the USML (US Munitions List): expressly military hardware and technology (missile systems, defense electronics, certain aeronautical components used exclusively for military purposes). EAR (Export Administration Regulations, 15 CFR 730-774) is administered by the Department of Commerce — the Bureau of Industry and Security (BIS) — and covers dual-use items classified by ECCN (Export Control Classification Number) on the Commerce Control List. In aerospace, a part can be ITAR (USML), controlled under EAR (an ECCN such as 9A610/9A991) or EAR99 (no license required unless the destination is sanctioned). Classification is step one and the most delicate one.

How is ECCN/USML classification done?

What screening was run? Who approved it? If all of that lives in emails and folders, the audit is weeks of misery.
